Have you been arrested?
Over 120,000 arrests occurred in the great State of Alabama in the year 2022. Often times, an arrest can bring feelings of panic, fear, and confusion. Should you find yourself in this unfortunate situation, below are some tips which may be helpful:
Comply with the law enforcement officer’s directions to the best of your ability. Do not escalate the situation.
While complying with law enforcement’s directions, refrain from providing any more information than is necessary.
Do not consent to any searches of your person, vehicle, or belongings. The Fourth Amendment affords protection against searches or seizures of you and your belongings without a warrant. If law enforcement asks to search you or your belongings, or initiates a search of you or your belongings without consent, calmly assert your Fourth Amendment right and decline the search.
Speak to your attorney as quickly as possible. Rule 4 of The Alabama Rules of Criminal Procedure affords you the opportunity to make a telephone call to any person you may choose without undue delay.
